The EJC sets aside the judgment of the EGC and annuls the EUIPO decision which confirmed registration of the shape of the Rubik’s Cube as an EU trade mark

On November 10, 2016, the Court of Justice of the European Union (ECJ) repealed the decision of the European Union Intellectual Property Office (EUIPO) made in 1999 and the judgment of the General Court of the European Union (EGC) dated November, 24 2014 , which confirmed the registration of the Rubik’s cube form as a three-dimensional Community Trade Mark. Thus, the EUIPO has to render a new decision, considering the findings of the ECJ.
