The processing of personal data of users of the websites www.byland.law, bylandlaw.com, bylandlaw.net and and christophbyland.com (hereinafter ‘the Web Sites’), and other persons whose personal data BYLAND.LAW processes, is subject to Swiss data protection law, in particular in accordance with the Federal Act on Data Protection dated June 19, 1992 (FADP) and – if and to the extent applicable – foreign data protection law, such as the General Data Protection Regulation (GDPR) of the European Union (EU). The EU recognises that Swiss data protection law ensures an appropriate level of data protection.
Processing of Personal Data
Personal data is any information relating to an identified or identifiable person.
A data subject is a person whose personal data is processed.
Processing is any operation performed on personal data, independently of the tools and processes used, in particular storing, disclosing, collecting, deleting, saving, altering, destroying or using personal data.
BYLAND.LAW processes personal data in accordance with Swiss data protection law.
Where the GDPR is applicable, BYLAND.LAW processes personal data according to:

if and when processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract. - Article 6 para 1 (c) GDPR:
if and when processing is necessary for compliance with a legal obligation to which BYLAND.LAW is subject. - Article 6 para 1 (d) GDPR:
if and when processing is necessary in order to protect the vital interests of the data subject or of another natural person. - Article 6 para. 1 (f) GDPR:
if and when the processing is necessary for the purposes of the legitimate interests pursued by BYLAND.LAW or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
Collection of Data
Visiting the Web Sites does not require identification or revealing of personal data by users.
However, while accessing the Web Sites web browsers of users automatically transfer the following log data to the web server for technical reasons:
– Date of access
– Time of access
– Referrer URL
– Downloaded files
– Data volume transferred
– Message on whether the data retrieval was successful or not
– Browser type and version
– Operating system type and version
– Host name of the user’s device (IP address)
These log data will be saved in log files by BYLAND.LAW’s hosting provider in order to comply with data security requirements. The log file data will be used in order to track unlawful access to the webserver, whether successful or not. Any other use of the log file data will only be made for purely statistical purposes in anonymized form.
Search terms entered into the search field on the Web Sites are used exclusively to run the search query.
Furthermore, the Web Sites use the WordPress plugin Akismet to identify spam.
Social Media Plugins
The Web Sites do not use social media-plugins.
Transfer of Data to Third Parties
BYLAND.LAW transmits personal data collected while using the Web Sites exclusively (a) with the explicit consent of the person concerned or (b) based on a legal obligation or (c) if necessary to enforce the rights of BYLAND.LAW, in particular the enforcement of claims arising from a contractual relationship.
Inquiry, Cancellation and Correction
Any user of the Web Site has the right granted by the FADP to submit free of charge any distinct written inquires to get access to his personal data collected while using the Web Sites. Furthermore, any user of the Web Sites has the right granted by the FADP to rectification of inaccurate personal data collected while using the Web Sites as well as the deletion of his personal data. However, BYLAND.LAW will only respond and grant these rights upon sufficient and accurate personal identification and written disclosure to BYLAND.LAW of the IP address(es) used by him while accessing the Web Sites.
